Venue in Civil Lawsuits

Venue refers to the location (city, town, or county) where a trial should be held. Each state has rules for determining the correct venue for filing a lawsuit. Improper venue is not a ground for dismissing a lawsuit. A defendant can waive or give up his right to claim improper venue. Either party can request a change of venue.

Grounds for Sanctioning State Judges

Judges are subject to standards of judicial conduct. Their actions are required to conform to certain norms and standards that relate to impartiality and ethical behavior. There are codes of judicial conduct for both state and federal judges. This article discusses cases in which state judges have been sanctioned or removed for ethical violations.

Federal Rules of Criminal Procedure

The Federal Rules of Criminal Procedure were adopted in 1946. They govern the practice and procedure in all criminal proceedings in the federal court system. The goal of the rules is to assure the just determination of all criminal proceedings. The rules specify that they are to be interpreted to afford simplicity in procedure and fairness in administration. The rules are intended to prevent unnecessary delay and expense.

Independence of the Judiciary

An independent judiciary is a fundamental principle of our democracy. The founding fathers assured the independence of federal judges by giving them tenure for life. The United States Constitution also prevents the reduction of a federal judge's salary while he/she is in office. The founding fathers also specified that federal judges could only be impeached and removed from office for committing treason, bribery, or other high crimes and misdemeanors.

Criminal Cases

A criminal case begins when the prosecutor files criminal charges against a person, a person is arrested, or the grand jury returns an indictment against a person. Criminal offenses are either misdemeanors or felonies. A misdemeanor is a crime that is punishable by jail time of up to one year. A felony is a more serious crime, which is punishable by prison time of more than one year.
